Mortgages in Spain for non-residents: bank requirements and preparation
How a non-resident can prepare for a mortgage in Spain: creditworthiness assessment, documents, FEIN and FiAE, the notary, costs and currency risk.

A mortgage for a non-resident in Spain starts not with a promised financing percentage, but with checks on creditworthiness, the property and the particular bank's terms. The loan amount, rate and document requirements depend on the client's profile and the lender's internal policy; there is no universal guaranteed offer for non-residents.
Rules checked on 23 October 2026 against Ley 5/2019 and Banco de España materials. This is not a bank offer or individual financial advice.
Calculate your own funds first
Divide the budget into the property price, purchase taxes and expenses, loan expenses, preparing the home and a reserve. The bank values the collateral, but the financing amount does not have to equal a particular percentage of the price or valuation. For planning, use only the bank's written decision and an explicitly stated calculation basis.
The formula for your own funds is simple: the full purchase budget minus the loan actually approved. Do not pay for taxes, furniture and the reserve with money needed for the part of the price not covered by the bank. A detailed cost calculation should be checked against the current version of the article on the full cost of buying.
What the bank checks
Article 11 of Ley 5/2019 requires a thorough assessment of creditworthiness before the contract is concluded. Employment, current and expected income, assets, savings, regular expenses and existing obligations are taken into account. The assessment must not be based primarily on the value of the collateral. See the current text of Ley 5/2019 and the Banco de España guide.
In practice, the bank may request a passport and NIE, proof of address and tax residence, an employment contract or business details, tax returns, bank statements, information on loans and the source of your own funds. This is not an exhaustive, official, universal list: the particular lender's request must be provided clearly and in advance, as required by Article 12 of the law.
Income in another currency
If your income or assets are not denominated in euros, demonstrate the stability of your cash flow to the bank and include currency risk in your own stress scenario. Do not assume that the current exchange rate will hold throughout the term. Request a written explanation of the currency in which the loan is made, whether special rules for foreign-currency loans apply, and what conversion rights the contract provides.
A property valuation does not replace due diligence
The bank valuation is needed for the lending decision and collateral. It does not confirm the absence of encumbrances, the legality of alterations, the technical condition or the property's suitability for your purposes. Carry out legal and technical checks separately. If the valuation is lower than expected, the difference cannot automatically be passed on to the bank: recalculate your own funds and the contract terms with the seller.
Before reserving, it is useful to provide a clear clause for the event of a refusal or an insufficient loan amount. An independent professional should check the wording; a simple phrase such as ‘purchase with a mortgage’ may not establish the intended consequences.
Which documents the bank provides before signing
Where Ley 5/2019 applies, the lender provides a personalised FEIN with the terms of the offer and a FiAE with key warnings, along with the other required documents. The law establishes a mandatory period before signing; the nationwide minimum is ten calendar days, although individual regional rules may contain specific provisions. Do not sign without comparing at least:
- the interest rate type, index and margin, payment schedule and total cost;
- discount conditions and linked products, including insurance;
- fees, early repayment and the consequences of late payment;
- requirements for the account, valuation and evidence of your own funds;
- foreign-currency loan terms, where applicable.
The content of the documents and the obligation to provide advance information are established by Article 14 of Ley 5/2019. An advertising simulation or a manager's verbal statement does not replace the FEIN.
Preliminary meeting with the notary
Before the mortgage transaction, free notarial advice is provided and a preliminary transparency record is drawn up, where the law applies. The notary checks that the documents were provided on time and explains the terms; this is a separate stage before signing the loan agreement. The borrower has the right to choose the notary. The general procedure is explained by Consejo General del Notariado.
Do not confuse loan costs with purchase costs
Under the current allocation of mortgage arrangement expenses, the client pays for the valuation and notarial copies they request; the lender bears the costs specified by law for arranging the mortgage loan itself. This does not mean that the bank pays for taxes and formalities relating to the home purchase. The official explanation is published by Banco de España.
What to obtain before making a non-refundable payment
- A written document checklist and a timeframe for review.
- A preliminary calculation of the loan amount and your own funds, without presenting it as a guarantee.
- A purchase contract clause addressing refusal or insufficient financing.
- FEIN, FiAE and annexes with enough time for comparison.
- Separate calculations of purchase costs and mortgage loan costs.
- Confirmation of the notarial consultation and final terms before signing.
Choose a property after defining a realistic budget range, but retain a buffer for changes in the valuation, exchange rate and bank requirements. You can start comparing properties in the Laverna Real Estate catalogue; the bank makes the lending decision, while independent professionals confirm the legal and tax consequences.
Stress-test the payment before applying
Prepare three scenarios: the current interest and exchange rates, a less favourable exchange rate between your income currency and the euro, and an increase in regular housing expenses. Separately set aside a reserve for purchase taxes and initial works: loan approval does not mean that the bank will finance these amounts. Compare offers by effective cost, term, early repayment conditions, mandatory associated products and the consequences of breaching terms, rather than only the advertised first-year payment.
Before signing, check the final terms against the bank's personalised documents and ask the notary questions during the period provided by law. A translation of an advertising calculation or a preliminary decision does not replace final approval of the specific property.
