New build or resale home in Spain: an honest comparison
You should choose between a new build and a resale home in Spain after answering three questions: when you need to move in, how much money you will need before moving in and which risks you are willing to accept. Choosing between a new build and a resale home in Spain should follow answers to three questions: when you need to move in, how much money you will need before moving in, and which risks you are prepared to accept. A newly renovated apartment is not necessarily a new build for tax purposes, and a recently constructed house is not necessarily sold directly by the developer. Compare specific transactions, not just the age of the buildings.
First, distinguish three different scenarios
- Buying during construction. You are assessing the project and the developer's obligations. Actual lighting, acoustics and finish quality cannot yet be checked as they can in a completed apartment.
- A completed new build. You can already inspect the premises, but must check the documents for handover and residential use, utility connections and the actual specification.
- Resale property. You can see how the building and surroundings function, the history of utility costs and the condition of communal parts. However, renovation inside an apartment does not eliminate potential problems with the roof, façade or utility networks.
Compare the total cost before moving in
In a separate table for each property, enter the price, taxes, transaction costs, professional fees, financing, necessary equipment, renovation and temporary accommodation. Parking, storage, air conditioning, appliances and landscaping must be explicitly included in the offer or costed separately.
Why an identical price does not mean an identical budget
According to AEAT's explanation, the first transfer of a home by a developer is usually subject to IVA, while a sale by a private individual and subsequent transfers usually fall under ITP. The definition of a first transfer takes the history of use into account: the word ‘new’ in a listing is insufficient. The tax calculation for a specific property must also consider the region, tax base, any AJD and eligibility for reliefs. AEAT's official explanation of new and resale properties.
A hypothetical example, not a market valuation: property A costs €260,000, with equipment and preparation for occupancy costing another €18,000. Property B costs €240,000, renovation €35,000 and temporary accommodation €6,000. Before taxes and transaction costs, the totals are €278,000 and €281,000 respectively. B's lower price no longer makes it cheaper. The figures in this example are invented; a real decision requires quotations and an individual tax calculation.
Move-in date: an advertising promise versus a contractual obligation
When buying a home under construction, ask for the contractual handover date, conditions for changing it, payment stages and consequences of delay. Establish separately which documents and connections must be ready when the keys are handed over. Being able to enter the apartment is not the same as being able to live in it immediately.
For a resale home, check when the seller will vacate, whether there are tenants and who is responsible for handing over furniture and equipment. If renovation is needed, request not only the cost but also the sequence of works, permit requirements and material delivery times. Do not base a move on a preliminary verbal forecast.
Which developer guarantees to check
The Building Regulation Act provides different liability periods: one year for workmanship defects affecting finishes; three years for certain defects that breach habitability requirements; ten years for structural defects threatening strength and stability. The periods run in relation to acceptance of the construction works, not automatically from your purchase. This is not a universal ‘warranty for everything’; liability conditions and time limits for bringing claims differ.
For advance payments on homes under construction, the law provides for repayment protection through insurance or a bank guarantee from the point when the building permit is obtained. Before payment, a lawyer should check which protection covers your particular amounts, to whom the money is paid and how the special account is arranged. Request documents relating to your purchase, not an advertising assurance that funds are protected. Ley 38/1999, Article 17 and the first additional provision.
What a resale home lets you check in advance
Visit the building in the morning and evening, and assess noise, parking access and routes to everyday services. Ask for the latest comunidad meeting minutes and information about planned works and payments. Fresh finishes in the apartment do not reveal whether spending on the lift or communal roof waterproofing is planned. Commission a separate technical inspection if there are signs of damp, cracks, altered terraces or doubts about utility systems.
Compare energy efficiency using documents too, rather than the building's age. When an existing home is sold, the registered energy certificate and label are attached to the contract. The rating is useful for comparison, but does not guarantee a specific amount for future bills: this depends on equipment and occupancy patterns. Explanation from the Ministry responsible for consumer protection.
How to decide without a universal ‘winner’
- You need a clear moving date: start with completed properties and check that they are genuinely ready for occupancy.
- You need a specific layout or specification: find out what the project allows and what changes cost before signing the contract.
- An established neighbourhood matters: compare actual routes and surroundings, not just distance from the sea.
- Your reserve is limited: rule out options that leave no funds after purchase for verified mandatory works and unexpected expenses.
The final profile for each candidate should contain the full budget, a verified readiness date, a list of unchecked documents and technical questions. It is sensible to make the final choice after independent legal and technical due diligence.
