Fianza for rentals in Alicante: checking the regional deposit and its return
Receiving fianza from a tenant is not the same as confirming the regional deposit. Link the contract, 806 or 816 route, number and eventual return.

Neutral editorial AI illustration of two closed folders, a model house and blank sheets on a desk; not an actual contract or evidence that a deposit has been lodged or returned.
An apartment owner in Alicante has received a payment labelled fianza from a tenant. A message says “the deposit has been arranged”, but it is unclear whether this means the owner received the money, a form was prepared or the deposit was lodged with the Generalitat Valenciana. These are different questions in a long-term letting. The useful decision is to establish the current stage and the appropriate regional route, rather than treat any bank transfer as completion of the entire procedure.
This article concerns lodging fianza in the Comunitat Valenciana and organising the owner’s evidence. It does not determine your contract type from its title alone, authorise deductions for damage or replace individual legal review. The regional deposit-return procedure and the final settlement between landlord and tenant must not be merged into one action either.
1. Identify the amount and contract before choosing a form
Start with the signed contract and the agreed description of payments. List rent, the amount called fianza and any other agreed security separately. Do not relabel the whole initial transfer as “the deposit” simply because the money arrived in one payment. If the contract, receipt and intermediary’s message use different terms, first ask how they correspond.
This step is not about reclassifying the contract yourself. Refer the applicable-regime question to a professional, particularly where actual use differs from the document’s title. An administrative form does not turn a disputed contract into an undisputed one or establish that all its terms are permissible. Further work needs a clear link between the particular contract, parties and amount.
2. Consider the regional route before filling anything in
GVA page 3023 distinguishes electronic lodging using modelo 816 from lodging through a cooperating bank using modelo 806. Both routes list a PDF contract, email address and the property’s cadastral reference. It specifies lodging within one month after the contract is concluded; subsequent return of an 816 deposit is requested only electronically with a certificate. It also describes a tenant’s written enquiry about whether lodging occurred, with copies of the contract and identity document. This is a brief reference to the regional instructions, not a full account of all their conditions.
Before choosing a route, establish who will act now and who will be able to deal with the deposit later. The convenience of today’s payment is not the only consideration. If the owner lives outside Spain, clarify available electronic identification and representation arrangements beforehand. Do not give access secrets to a helper or treat an ordinary letter as authority for every action.
Do not replace the stated calendar reference with an approximate number of days from somebody else’s checklist. If timing is already uncertain, retain the actual contract date and seek clarification of the current procedure. This article does not calculate surcharges, suggest changing the contract date or promise that late action will have no consequences.
3. Match the property and parties before submission
Prepare a copy of the contract actually signed by the parties, not an intermediate negotiating draft. Check the apartment’s address and designation against available documents. Do not substitute a bank transaction number or a similar identifier for another unit in the same building for the cadastral reference. If something differs, ask for clarification before using the disputed value.
Check separately who is named as landlord and who is actually organising submission. The owner, representative and manager may share an email thread, but their roles are not interchangeable. Record who handles contract questions, who is responsible for the procedure and who will receive confirmations. Do not use another owner’s details as a technical workaround.
A working table can contain four fields: contract, property, amount and responsible person. Its purpose is not to create another mandatory form but to reveal inconsistency before payment. If a row remains unconfirmed, mark it as a question; do not fill the gap with a confident guess merely to finish quickly.
4. Distinguish a prepared form from a confirmed action
A form saved on a computer does not, by itself, explain what happened next. In your records, distinguish data preparation, the action actually taken and the confirmation received. A filename saying “finished” is not proof of payment or registration. Look at the document’s contents and, if unclear, ask about its purpose through an official channel.
If a helper performs the procedure, ask for the confirmations relating to your contract, not merely a short success message. Match the number, property and amount against the starting documents. Do not demand their passwords or their entire account history: you need a verifiable result of a specific assignment, not access to all the representative’s information.
If a fault occurs, do not repeat the payment just because the screen disappeared. First establish whether the action was accepted and what confirmation is available. Retain the observed message, time and transaction information without publishing payment details. This organisational approach does not determine a particular payment’s status; it helps avoid creating a second action instead of diagnosing the first.
5. Retain the deposit’s link to the contract, not just a bank entry
It is useful to keep the contract, chosen route, deposit number and confirmations together in the file, with clear names. Keep original files and your explanations separate. Do not amend details inside an issued document yourself: if an error is material, ask for the proper correction route and preserve the link between old and new versions.
A bank statement can help reconstruct money movements, but does not answer every question about which contract an action concerns. Matching amounts are not enough if the owner has several apartments or contracts with similar payments. Each case needs its own sequence, not a general “deposits for the year” file without clear links.
Limit access to the contract, identifying details and signatures. For advice, send necessary information to a verified recipient. A copy of the whole file in an open residents’ chat does not improve the evidence and exposes more data. Working translations can be attached separately while retaining original Spanish document names.
6. Answer the tenant about the specific stage
If the tenant asks whether the fianza has been lodged, a precise answer with confirmation relating to the contract is more useful than “the agency has the money”. Explain which action the document shows without attributing further qualities to it. Confirmation of an administrative deposit is neither an assessment of the apartment’s condition nor agreement to future deductions.
If you need to contact the administration, use current contacts on the official page, not an address from a forwarded screenshot. Prepare only the materials required for the enquiry and a clear question. A lack of response in correspondence with an intermediary does not yet prove that no deposit exists; it is a reason to request information, not publicly declare a breach without checking.
7. Do not lose the fianza history when ownership changes
If buying an apartment with an existing contract, include the deposit history among your questions for the seller and lawyer. This does not replace reviewing the tenancy itself, the parties’ rights and the sale terms. The practical task here is narrower: understand which documents exist, who lodged the deposit and how the confirmations connect to the continuing relationship for that apartment.
Do not automatically lodge a new deposit just because the owner’s name has changed, and do not use the former owner’s personal access. First ask a competent contact which procedure applies. Record separately what information has been passed to the buyer and which actions still need professional explanation. “We will find the number later” leaves an organisational risk unresolved.
8. Separate return by the Generalitat from settlement with the tenant
GVA 2739 describes return of the regional deposit after the contract ends. For 816, the route is electronic; for 806 lodged through a bank, electronic or bank routes are provided, with electronic handling specified if the original 806 is lost. The page separately addresses an applicant who is now the owner but did not originally lodge the deposit. It helps identify the relevant branch, but this article makes no promise about when money will actually be transferred.
First establish which deposit and which contract termination are involved, then match the documents to current instructions for the selected branch. Do not submit information from another contract to obtain a similar-looking form. If the applicant’s name differs from the old document or the original is lost, do not conceal it: that circumstance affects the question you need to ask.
Keep a separate list for settlement between the tenancy parties: what has been handed over, which amounts are under discussion and which disagreements remain. The owner’s request for regional return does not itself resolve a damage dispute or establish the amount of a lawful deduction. A right to delay settlement with the tenant cannot be inferred solely from an administrative transfer still being awaited. Individual deadlines and grounds require legal review.
9. Finish preparation with a clear owner decision
A good outcome is being able to explain what is confirmed, which route was chosen, where the deposit number is and who is resolving remaining questions. If only a document copy is missing, that is one task; if the contract, amount or participant is unclear, it is another. Do not hide these distinctions under a general “processing” status.
For letting a home on the Costa Blanca, this helps separate money received under the contract from an administrative action and a future settlement with a person. The article does not certify the correctness of a particular contract or deposit. Its practical result is a verifiable sequence of actions and questions, not a promise of an undisputed refund or automatic compliance with every requirement.
