Modelo 211 when buying a home: withholding, payment and the seller’s copy
A withholding figure in the calculation does not close the task. Agree the Modelo 211 applicability check, responsible person, payment evidence and delivery of the seller’s copy.

When buying a home on the Costa Blanca, writing “withholding accounted for” in the seller settlement is not enough. The buyer needs to understand who checks whether Modelo 211 applies, who prepares submission, what proves payment and how the seller will receive their copy. These actions concern a specific property transfer, not a general purchase-cost spreadsheet. Agree them before signing, while documents can still be checked and tasks assigned without haste.
This article proposes a way to organise the work, not an individual tax calculation. It does not establish the parties’ residency, promise freedom from debt or guarantee a seller’s refund. Your transaction requires its documents and a professional check of applicable rules. In particular, do not substitute nationality, possession of an NIE or a usual correspondence address for tax residency.
First establish which obligation is involved
Article 25.2 of the IRNR law links acquisition of Spanish property from a nonresident without a permanent establishment to withholding or the corresponding payment on account by the buyer: 3% of the agreed consideration. This is a payment towards the seller’s tax, not a universal final tax rate. The law provides an exception for property contributed to the capital of Spanish companies; rules cannot be applied to any transaction merely because its name sounds similar.
Ask the professional assisting you for a short answer concerning the actual parties: is your transfer being treated under this regime, on what documents is that based, and what remains unestablished? If the answer is conditional, keep it conditional in the working calculation too. “The seller has lived here for years” is not a substitute for the evidence supporting the conclusion, and a Spanish identification number alone does not answer the tax-status question.
Define the assignment’s boundaries separately. Checking applicability, preparing the form, arranging payment and delivering confirmation are different tasks. One professional may perform them all, but this must be clear from the agreement, not assumed by the buyer. Also record who will answer after signing if the main contact is unavailable.
Do not mix money for the seller with money to be remitted
Separate lines in the transaction calculation are useful: agreed price, amounts already paid, amount payable to the seller and amount allocated to the withholding under consideration. This is an organisational reconciliation, not a formula for every situation. If other retentions, debts or settlements appear, ask for each line to be explained separately so that the same word “withholding” does not conceal different grounds.
The buyer’s practical question is: “Where exactly is the money, who controls it for this task, and what document will I receive once it is done?” “Everything is included in costs” is too vague for oversight. Ask how the amount in the calculation connects to the instruction given to the person carrying it out, without revealing account details and personal data in a general thread involving everyone attending viewings or helping with the move.
If the calculation changes before signing, update the agreed version as a whole. Do not leave one amount in an email, another in a table and a third in the attached draft. Marking the version date and naming the document used for reconciliation is useful. This does not establish tax correctness, but can expose an ordinary copying error before it spreads into several subsequent documents.
Check the parties and property, not just the total
AEAT instructions provide for a separate self-assessment for each property acquired and annexes where there are multiple buyers or nonresident sellers. Where owners include both residents and nonresidents, the calculation takes the part of the consideration attributable to nonresidents. The total price and a list of names therefore do not yet explain the allocation in an individual case.
Ask the person preparing the form to connect its data to your purchase documents: which property is represented, which parties are included and what supports the stated shares? If an apartment, parking space or another unit are acquired together, do not combine or split them for the form yourself. First ask the professional how the properties are documented and what set of filings is required.
With several buyers, appointing a single correspondence coordinator is convenient, but does not automatically make them the only participant or obligated person. Have the professional explain how the other buyers are shown and who receives the final package. Similarly, a single seller-side contact does not mean the others’ details may be omitted or replaced with that contact’s information.
Anchor the calendar to the confirmed transfer date
Article 14 of the IRNR regulations requires the buyer to file and pay within one month of the transfer date. It also provides circumstances where withholding is not required, including proof that the seller is subject to IRPF or corporate income tax through a certificate from the competent tax authority. Do not decide whether an exception applies by a document’s appearance: a professional must check its relevance to the particular transfer.
In the task calendar, record the starting date, the document it came from and the agreed completion deadline. Do not automatically replace it with the date keys were received, an agent’s email or a bank transaction. If parties disagree about when the transfer occurred, ask them first to resolve that discrepancy rather than choose the most convenient starting day.
Besides the final deadline, agree an earlier internal review: when the buyer will see the prepared data and when confirmation of the result will arrive. These are working checkpoints, not extensions of the statutory period. Keep a separate task for verifying completion: “call the professional” and “filing confirmed” should not look like the same status.
Distinguish preparation, submission and confirmed payment
A completed file shows the contents of the prepared document, but alone does not answer every question about execution. Ask which documents confirm filing and payment under the chosen method. Do not conclude that everything is finished merely from a filename, a screenshot of a bank instruction or “sent”: first establish exactly what was sent and what result was received.
AEAT instructions describe electronic and paper routes, as well as a specific procedure for transfers from abroad. For such transfers, the payment identification required by the system matters; the date a bank instruction is sent is not the same as confirmed receipt by the Treasury. Do not copy payment details from an old transaction or someone else’s example. Obtain the execution method and current payment details through the official route for your filing.
If the status is unclear, first reconcile what has already happened: which document was created, which identifier was received, what result the preparer can see and what the bank confirms. Do not request another payment “just in case” until the first transaction’s status is established. Keep the problem message and pass it to the person handling submission; a correction or repeat action must be based on a specific verification result.
Agree delivery of the seller’s copy beforehand
Article 8 of Orden EHA/3316/2010 provides Modelo 211 copies for the buyer, cooperating institution and nonresident seller. After payment, the buyer delivers a copy to the seller to support the payment on account in the seller’s own return for income from the transfer. Preparing the buyer’s package and delivering the required document to the seller are therefore not interchangeable actions.
It is useful to name the agreed seller-side recipient and delivery method in the instruction to the person handling the task. Ask for confirmation not only of sending but also that the recipient can access the file. This is particularly helpful if the parties travel away, change phone numbers or deal through different representatives after the sale. Verify the recipient before sending, rather than pick a similar surname from an old email chain.
Do not put the entire package, including identifiers and addresses, into an open apartment chat. Send necessary documents to the agreed recipient through the channel chosen by the parties. For your task list, recording delivery date, recipient and where the confirmation is stored is enough; do not duplicate sensitive details across every calendar and message.
Do not describe Modelo 211 as the seller’s final assessment
The buyer’s Modelo 211 and the seller’s Modelo 210 serve different purposes. The regulations provide for a subsequent final assessment by the nonresident, crediting the amount withheld, and possible refund of an excess after necessary checks. Withholding alone does not mean a refund is due, already approved or equal to the entire amount withheld. This article does not calculate the seller’s income, expenses, reliefs or ultimate liability.
A reasonable boundary for the buyer is to obtain evidence that their task was carried out and deliver the required copy. If the seller asks about a future refund, refer the question and transaction documents to their tax professional. Do not let that question replace verification of payment already made, or promise the other party an outcome to speed up signing.
Simple labels can be used in shared correspondence: “prepared for review”, “filing result received”, “payment confirmed”, “copy delivered”. These are organisational labels, not official tax categories. Use them only in line with available evidence, so a spreadsheet tick does not falsely imply that every tax matter connected with the sale is finally closed.
Close the document task while keeping unresolved questions visible
Before closing the working list, request a final reconciliation: are the correct property and parties recorded, does the amount match the agreed calculation, have result documents been received and has the copy reached the seller? If data were corrected, retain the link between the original and subsequent documents. Do not delete an older file simply because a new one exists: first ask the person handling it how they relate.
Record remaining questions and who is responsible separately. For example, delivery confirmation may still be outstanding although payment is confirmed; or a document has arrived but a party’s details differ. Such a note is more useful than “everything done”. It lets the next professional work from facts rather than reconstruct participants’ spoken promises.
Buying a home in Alicante, Elche or another Costa Blanca town often brings several parallel tasks: settlements, documents, moving and connecting services. A dedicated Modelo 211 workflow helps preserve this particular link between withholding, payment and the seller’s copy. It does not replace transaction review or remove other obligations, but makes clear which result the buyer can request from the person carrying out the assignment.
