NIE for buying property in Spain: what you need to know

How to obtain an NIE to buy property in Spain: EX-15, the 790-012 fee, applying in person or through a representative, and important limitations.

Panorama of the Spanish coast and residential areas

Foreigners need an NIE for many economic and administrative actions in Spain, including completing a property purchase. It is an identification number, not permission to reside or work, or a guarantee of opening a bank account. We explain who issues it, which documents to prepare and how to avoid jeopardising the transaction through mistaken expectations.

The procedure was checked on 23 October 2026 against information from the Ministerio del Interior. Before applying, check the requirements of the specific authority and appointment availability.

What is an NIE?

The Número de Identidad de Extranjero is a foreigner's unique personal number in Spain. In the official procedure, the basis is the existence of economic, professional or social interests connected with Spain. A planned property purchase is an economic reason, but the application itself must be properly justified.

Do not confuse three concepts: the NIE as a number, the EU citizen registration certificate and the TIE as a foreigner's identity card in the cases provided for by law. Obtaining an NIE does not, by itself, legalise a person's stay, authorise work or confer tax residence or a residence permit.

Where to apply

The official Policía Nacional page provides for applications in Spain in person or through a representative, and outside Spain through a Spanish consulate. In Spain, the competent bodies are the police units/immigration authorities at the place of application under the established procedure. Actual appointment availability depends on the office, so do not tie the transaction date to an unconfirmed issue timeframe.

The current procedure, document checklist and links to forms are available on the Ministry of the Interior's official NIE page. Forms for procedures relating to foreigners are published in the official applications section.

Basic set of documents

  • Completed and signed EX-15 form.
  • A valid passport or another admissible document; the official checklist requires the original and a copy.
  • A written explanation of the economic, professional or social reason for the request.
  • Proof of payment of the applicable government fee using form 790, code 012.
  • When applying through a representative: proper evidence of authority and the representative's documents.

The exact set depends on the place and method of application. For a purchase, it is useful to attach a document that truthfully confirms the planned transaction, but do not sign a risky non-refundable contract merely to obtain an NIE. The purpose of the procedure can be supported by a safe document after consulting a professional.

How to complete the application without inconsistencies

The given name, surname, date of birth, nationality and passport number must match the identity document character for character. Use one spelling in all transaction documents, bank forms and the power of attorney. If your passport has changed or there are several transliteration variants, clarify in advance how to link the documents rather than correcting details yourself after signing the contract.

For the reason for your request, state the actual transaction, for example completing a planned property purchase and the related tax procedures. Do not claim fictitious employment, residence or urgency. An error in the grounds or an incomplete document may mean having to apply again.

Applying through a representative

The official procedure allows representation, but authority must be documented. A power of attorney issued outside Spain may require legalisation or an apostille and an official translation, depending on the country of issue, language and form of the document. Agree the wording with a Spanish notary or lawyer before signing: overly narrow powers may not cover the application, while excessively broad powers create unnecessary risk.

A representative cannot honestly guarantee a specific date for the number to be issued. Check the payment recipient, the basis of the service and refund conditions. The government fee and an intermediary's fee are separate payments.

When the NIE will be needed during the purchase

The number is used to identify the buyer in transaction documents and tax procedures. The bank and service providers may also require it, but having an NIE does not oblige the bank to open an account or approve a mortgage: the financial institution carries out its own checks on identity, source of funds and creditworthiness.

An NIE does not replace legal due diligence on the property. At the same time, request current information about the owner and encumbrances, and check the contract and full budget. The sequence of the entire transaction is described in the article how to buy property in Spain as a foreigner.

Pre-application checklist

  1. An official route has been chosen: the police/immigration authority in Spain or a consulate.
  2. The details on EX-15 match the passport in full.
  3. The reason for the request is supported by a truthful document.
  4. The fee has been paid using the current form and proof retained.
  5. The representative's powers specifically cover this procedure.
  6. The purchase timeframe is not based on a promised but unconfirmed issue date.

After receiving the number, check the spelling of the details before using it in a contract. To choose a property, visit the Laverna Real Estate catalogue; deal with questions of immigration status, taxation and representation separately with relevant specialists.

The NIE does not replace other identifiers and documents

An NIE is a foreigner's identification number, not a resident card, permission to reside or evidence of tax residence. Different procedures may additionally require a valid passport, proof of address, a representative's authority and tax forms. The bank and notary also need documents on the source of funds and parties to the transaction; having an NIE does not exempt you from these checks.

After it is assigned, recheck the spelling of your name, passport number and the number itself in all draft documents. Different transliterations can delay banking and notarial procedures. Do not send an NIE scan to random intermediaries: before transferring personal data, verify the recipient, purpose and secure channel.
