Nota Simple: the key document before buying a home in Spain
What a Nota Simple shows: the owner, description of the finca and encumbrances. How to read the extract, what it does not confirm and when to request a new one.

A Nota Simple helps you understand exactly what is recorded in the Registro de la Propiedad: which finca is described, who is listed as the owner and which rights or encumbrances apply. It is an important document before reservation, but not a ‘clean bill of health’ for the property or a substitute for comprehensive due diligence.
Sources checked on 23 October 2026. Analysis of the extract depends on the specific finca and the circumstances of the transaction.
What a Nota Simple shows
The official Registradores de España electronic office identifies three main groups of information: identification of the finca, registered rights holders, and the content of existing rights, such as ownership, a mortgage or usufruct, including their scope and limitations. The extract may also show attachments, easements, conditions or other entries if they have been recorded in the register. Request the document through the official Registro de la Propiedad service, rather than an unknown intermediary website.
How to make sure the extract relates to the correct property
Compare the address, description, area, boundaries, floor, premises, CRU/IDUFIR and cadastral reference with the contract, cadastre and physical inspection. The address in the listing may be abbreviated, while parking or a storage room may be separate fincas with their own extracts. If the seller promises to include them in the price, this must be checked and recorded in the contract.
The registered owner and the seller's authority
The seller's name must be consistent with the registered owner. Multiple owners, inheritance, a company, a representative or family rights will require additional documents and signatures. A Nota Simple alone does not confirm the signatory's identity or the validity of a power of attorney. Before payment, a lawyer must check the authority and any legal regime affecting disposal of the property.
How to read encumbrances
A mortgage does not always make a sale impossible, but it requires a clear mechanism for repayment and removal of the entry. Amounts in a registration entry should not be treated as the current outstanding debt: request confirmation from the bank and agree the payment arrangements. An attachment, easement, prohibition on disposal or condition requires a separate legal assessment. Do not rely on a promise to ‘remove it after the transaction’ without documents, deadlines and a safe payment procedure.
What a Nota Simple does not confirm
- The actual technical condition, damp, defects and quality of renovations.
- The legality of every alteration or compliance with municipal permissions.
- The absence of outstanding comunidad, IBI and utility contract debts.
- The possibility of tourist letting or transferring a licence.
- The exact tax calculation and bank valuation.
The official government portal also recommends checking the property's characteristics, owner and encumbrances through the Registro de la Propiedad before purchase: the property purchase guide.
Nota Simple and certificación
A Nota Simple is informational and does not certify the content of entries with evidentiary force. Registradores explains that a certificación signed by the registrar is used to provide authoritative confirmation of the register's content. The difference is explained in the official Registradores guidance. A professional determines which document is needed in a particular situation.
When to update the extract
Request it before taking on obligations and update it before signing before the notary if a significant time has passed or new circumstances have arisen. Keep the received file, date and finca identifier yourself. The notarial check immediately before signing does not remove the need for earlier checks, when the buyer can still negotiate terms or withdraw without losses.
Next step
Before reserving, combine registration details with municipal, cadastral, technical and contractual documents. The full list is provided in the legal due diligence checklist. Laverna can help gather information on the chosen property, but an independent legal opinion must address your specific transaction.
A practical procedure for reading the extract
- Record the issue date: an old extract does not show subsequent entries or submitted documents.
- Compare the finca registral, address, floor, area and anexos with the contract, cadastre and physical inspection.
- Check ownership shares and registered owners; establish the signatory's authority for each seller.
- Distinguish current cargas, discharged obligations and entries requiring explanation from the registrar or a lawyer.
- Before making a non-refundable payment, order an updated extract and repeat the comparison.
Typical discrepancies that cannot be resolved verbally
A parking space or storage room may be a separate finca, a share or an element linked to the apartment; this affects the description of what is being sold. An enclosed terrace, extension or combined room may physically exist but be absent from the register or municipal documents. A Nota Simple shows registration information, but does not confirm technical safety, an occupancy licence, the absence of planning infringements or comunidad debts.
If a mortgage, attachment, easement, prohibition on disposal or condition is listed, do not try to reduce it to a single amount yourself. A lawyer must determine whether the entry prevents the sale, which document is needed for cancellation and when it will be submitted. The contract records the removal procedure and proof of completion, not a promise that ‘everything will be removed at the notary's’.
Checks before signing before the notary
A few days before the transaction, obtain an up-to-date extract and a written plan for removing each encumbrance. Compare it with the final draft escritura: the price, finca, owners, anexos and allocation of payments must match. After registration, request new information to confirm the transfer of ownership and the expected state of the entries. Keep dated versions of documents: a reference to an extract viewed earlier does not prove the register's state on the transaction date.
Repeat the comparison after any change to the transaction terms.
