Marital status and buying a home in Spain: form of ownership

How marital status and a matrimonial property regime affect buying in Spain: purchasers, shares, foreign documents and the draft deed.

When buying a home in Spain, it is not enough to put in the contract the name of the person conducting negotiations. The notary and registry need to know who acquires the property, in which shares and which property regime applies. For an international family, the answer may depend on marriage, residence, nationality, spousal agreements and foreign documents.

Why the question is asked before completion

The form of ownership affects the deed, later disposal, a spouse's participation and inheritance and family issues. Correcting incomplete information on the final day is inconvenient and may be impossible without more documents. Discuss marital status, property regime and intended shares with an independent lawyer and notary before the deposit or cover the issue in a reviewed contract.

Do not answer “everything is separate” without a document and analysis of applicable law. A couple's practical division of money does not always match the legal regime. It is equally unsafe to assume that registration in one name automatically excludes another person's rights or participation.

Information to prepare

Prepare a short questionnaire for each buyer: nationality, habitual residence, marital status, date and place of marriage, previous marriages, marriage contract or other agreement, intended share and source of funds. If a buyer acts through a representative, add the power of attorney and details of its use.

Ask the specialist in advance which documents and rules on form, translation, apostille or legalisation apply. Do not commission a translation until the required document is confirmed. A foreign certificate may have limited practical currency or require further confirmation.

One buyer, spouses or several co-owners

A deed may name one or several purchasers, but the correct structure is not solely a matter of preference. If spouses buy, the notary identifies the applicable regime and records it. For unmarried partners or relatives, define shares, financial contributions and use precisely.

Do not choose “half each because it is simpler” where contributions, finance and future expenses differ. Record price, transaction costs, initial payments, loan obligations, shares and contingency in a table. A mismatch is not necessarily wrong, but it must be deliberate and reviewed for legal and tax consequences.

If one spouse buys, the specialist checks whether the other must be mentioned or participate and how the regime is recorded. Notariado material also notes both spouses' participation in disposal of the family home in certain cases. Do not transfer that example to an international buyer without analysis.

Foreign matrimonial property regimes

An international couple may need to identify the applicable law rather than select the closest Spanish label. The regime's name abroad may have no exact equivalent. The notary needs facts and documents and the translator needs full context. Do not ask an agent to choose between gananciales and separación de bienes from one message.

For participating states, Regulation (EU) 2016/1103 contains rules on choice and determination of applicable law. Article 26 points successively to the spouses' first common habitual residence after marriage, their common nationality at the time of marriage and, failing those, the closest connection at the time of marriage, considering all circumstances. Special rules apply to multiple common nationalities and certain judicial exceptions. This does not mean Spanish sociedad de gananciales automatically applies to everyone buying in Spain.

Transitional rules need separate attention. Taking the official corrigendum into account, Article 69(3) applies Chapter III on applicable law to spouses who married or chose the law applicable to their property regime on or after 29 January 2019. For an earlier marriage or choice, do not apply the chapter mechanically: a specialist must determine the conflict rules and review the family's documents.

If the regime changed, prepare the amendment and its effective date. If there is a marriage contract, the specialist must examine its form, content and relevance. Translation of the first page alone does not establish the whole regime.

Also disclose pending proceedings, separation or circumstances affecting powers and property. This is sensitive information; share it only with professionals who need it through an agreed secure channel.

Linking shares and finance

A bank assesses borrowers and security under its own rules. Borrowers, payers and registered owners are not automatically identical. Before reservation, confirm with the bank and lawyer that the intended structure is compatible with the loan and how much each participant must provide.

Keep evidence of transfers and source of funds. If one participant finances another's share, separate civil and tax issues may arise. Do not call a payment a gift, loan or family transfer without advice and documentation.

Use of the home and future decisions

Shares answer ownership questions but do not fully regulate daily life. Co-buyers should discuss in writing residence, letting, works, expenses, document storage, community voting and what happens if one wishes to leave. It need not all appear in the deed, but the absence of an agreement creates risk.

Do not try to resolve succession solely through shares. Wills, applicable succession law and family rights are separate work. A purchase may prompt an update, but this article offers no universal inheritance structure.

What to check in the draft deed

Obtain the draft early and check names, document numbers, addresses, marital status, regime, shares, property, price and payment method. Compare it with mortgage papers and the deposit agreement. Correct discrepancies before visiting the notary.

If you do not read Spanish confidently, agree translation and explanation arrangements. Signature confirms acceptance; lack of time is no basis for approximate understanding. Ask about every phrase affecting an owner or share.

Checklist before a binding payment

  1. All purchasers and proposed shares are identified.
  2. Marriage and property-regime details are prepared.
  3. A list of foreign documents, translations and formalities was obtained.
  4. Compatibility of owners and borrowers with the mortgage was checked.
  5. Contributions and transfer evidence are recorded.
  6. Use, expenses and exit from co-ownership were discussed.
  7. The deed draft was compared with reservation and bank papers.
  8. Separate inheritance and tax advice is planned.

The aim is not to choose the “best” regime from an article but to give the notary complete facts and obtain a correct structure for the family. Sources checked on 25 October 2026: the Civil Code on BOE, Regulation (EU) 2016/1103, its official corrigendum to Article 69 and Consejo General del Notariado family materials. Regional civil law and foreign conflict rules require separate analysis.
