A marina and residential property on the Spanish coast

Short-term rentals in Spain are not governed by a single ‘licence’. Before buying, you need to check the region, municipal compatibility, the comunidad, national registration and the technical readiness of the specific home.

Rules checked on 23 October 2026. Requirements depend on the territory, the activity's start date and the property.

Four levels of checks

  1. Region: the tourist rental regime and housing requirements.
  2. Municipality: planning compatibility and local restrictions.
  3. Comunidad: the law, statutes and owners' resolutions.
  4. National system: a number in the Registro Único de Arrendamientos for listings through online platforms under Real Decreto 1312/2024. This number does not replace regional or municipal authorisation.

The comunidad after 3 April 2025

For a new activity in a building under propiedad horizontal, Article 7.3 of the Ley de Propiedad Horizontal requires prior express approval from the comunidad under the procedure in Article 17.12. Official practice confirms that the rule applies from 3 April 2025: BOE decision. Transitional circumstances and the status of an existing activity are checked separately.

Example: Comunitat Valenciana

The regional regime was amended by Decreto-ley 9/2024. Electronic procedures are published by Turisme Comunitat Valenciana. Before reserving, request the applicable municipal document and check the registration's duration and conditions. An old number in a listing does not establish that the activity can continue after the sale.

The seller's dossier

  • the registration number and the basis on which it was obtained;
  • identification of the same property in the land registry and cadastre;
  • municipal compatibility;
  • the comunidad's statutes, minutes and approval;
  • information about penalties or compliance orders;
  • technical documents and insurance.

Tax classification

This also depends on the services provided. Agencia Tributaria distinguishes simply providing accommodation from an activity involving hotel-sector services: official IRNR explanation.

Protecting the purchase

If the rationale for buying depends on tourist rentals, the contract must list the necessary confirmations and the consequences if they are missing. Calculate a fallback scenario of personal use or lawful long-term letting. Check the financial model using the article on net returns.

A national number does not replace permitted use

The Registro Único de Arrendamientos identifies a unit for operation through online platforms, but does not legalise a use prohibited by regional, municipal or building rules. Before buying, check both levels: the ability to obtain or retain the number and the substantive right to carry on the chosen activity at the address.

Municipal compatibility

Request the document or written confirmation required for the chosen municipality and match the exact address, cadastral identification and land registry identification. A rule applying to the neighbouring building is not evidence. Also check the validity period, grounds for termination and consequences of a change of owner; an old listing with a number does not answer these questions.

Comunidad: four different documents

  • the registered statutes and the restrictions they contain;
  • the latest meeting minutes;
  • express approval for the new activity where required by Article 7.3 LPH;
  • rules on communal areas, access and any special cuotas.

The administrator's verbal opinion is useful as a guide, but does not replace documents. For an activity begun before 3 April 2025, a lawyer must check the actual start date, previous compliance with sector rules and the applicability of the transitional provision.

Technical readiness and operation

Check capacity, ventilation, fire safety, access, equipment and mandatory guest information against regional requirements. Check insurance and the management agreement. Furniture and photographs on a platform do not establish the property's compliance or the transfer of contracts to the new owner.

The purchase agreement when rentals are critical

List the documents the seller must provide, the review deadline and the consequences of a negative response. Describe the transfer of accounts, bookings, deposits and personal data separately: they do not automatically transfer with the apartment. A lawyer must agree the arrangements for existing future arrivals and obligations to guests.

A fallback scenario

Assess personal use or lawful long-term letting without assuming that income will stay the same. If the purchase is financially acceptable only with unconfirmed tourist rental operation, the risk must be reflected before the deposit, not after registration is refused.

Taxes and reporting cannot be inferred from the word ‘tourist’

Classification depends on the owner's status, services provided, the existence of a permanent establishment and other circumstances. Clarify IVA, IRPF or IRNR, registration and information obligations separately. Platform commissions and withholding do not mean that all obligations have automatically been fulfilled. Obtain a personalised filing calendar and retain evidence of income and expenses.

Transfer of an operating business

If the seller presents a rental history, reconcile payouts, bookings, commissions and the management agreement. Establish which contracts can be transferred, which require consent and who is responsible for cancellations after the transaction. An account rating or platform reviews may belong to the operator rather than the property; do not include them in the price without a confirmed right of transfer.

In the final dossier, list permits, the national number, comunidad documents, municipal compatibility, technical requirements and tax advice separately. The presence of the others cannot make up for one missing link.

Repeat the checks immediately before signing: municipal restrictions, comunidad resolutions and registration status may change between the first viewing and the transaction. State the date and validity period of each response in the report. If a response was only verbal, mark it as unconfirmed and do not include expected income in the essential debt-servicing budget.
